Dish Network Seeks Ways to Redesign Around TiVo’s Patent

Last March 10, 2010, Dish Network and EchoStar appeals to their patent infringement case against TiVo regarding the Digital Voice Recorder.  They have sought approval to redesign their device around the technological patent claimed off by TiVo.

The lawsuit was originally filed by TiVo against EchoStar Corp. when Dish TV Network was still under EchoStar’s umbrella.  TiVo won the case in 2006 under the ruling of U.S. District Judge David Folsom where he compelled Dish Network to get pre-approval before defining changes to their device and to avoid further association or resemblance with TiVo’s own invention.

Englewood-based Dish Network on the other hand, continued to distribute their DVR service which prompted Judge Folsom to put Dish Network and EchoStar in contempt last year.  This order was however, suspended when Dish Network and EchoStar filed an appeal to reconsider.

Last March 9, the two companies filed the details of the design changes in a federal court in Marshall, Texas.   TiVo immediately responded on March 10 to the U.S. Court of Appeals for the Federal Circuit with a request to prohibit Dish Network from further distributing their DVR service effectively. 

On their last court appeal, Dish Network claimed to have 15 engineers spend 8,000 hours on the redesign, but the Federal Circuit ruled the case on TiVo favor.
